Bit tho 'Sea Serpent we have received two copies of the flaakes Bay Herald, dated ' respectively tho 17ih and 24tti July. Tim Herald of the 10th July-oame to' hand previously; but we notice that the papers of the I.7th and 24th'ore both dated-the 40th over their leader head. The paper of the 17th contains a notice for iho' election of one member of the House of Representatives far the Wairarapa and Hawke's Bay District. Mr. Ogi'lvie, the. Returning Officer, hud appointed the Nomination to tuke place at Castlo Point on the 22nd instant, and in the event of a poll being for the Candidates, the polling to take place on the 29ih. This intelligence has taken ■us all by surprise, for we were not aware of the issue of the writ; and wo question much if -any of the Wuirarupa electors, who are so deeply interested in tho result, are yet made acquainted with the fact. In our opinion the legality of this proceeding can be questioned.
Tlio 40lh clause of the Constitution Act runs thus :—
40. Tlie Returning Officer shall endorse on the Writ the (lay on which he may have received it, and shall fix the day of Nomination, and also the day on which the voting, if necessary, shall take place, and shall give notless than Fourteen Jays' Public Notice thereof respectively.
Now, the first public notice of the election appears in the Herald of the 17th, aud the nomination is appointed to take place on the 22nd, so thai five clays' notice is only given, instead of fourteen as required by law. The Herald of the 17th says : —
We have not as yet heard of any other candidate than Mr. Ferguson, who has proceeded to the place of nomination ; but of course the Wainuapa electors have yet to he consulted in the matter. The writ is made returnable iv f>o days, so that the utmost expedition is necessary : and the place of nomination (Castle Point) being some hundred and twenty miles distant from Napier, we will barely have time to learn something of the nomination on the IMnd, before we shall be called upon, in case of a contest, to record our votes on the SiltU. ■ When is each district to have its own representative ?,
Mr. Carter is n Candidate for the Re presentation of tho Wairarupa mid Hawko'a Bay District, and will be taken at. great disadvantage ; fur although his address to tho electors appoared on the 17th July in tho Wellington papers, the same day as tho Returning Gllicor's notice was published in xhe llaivke'x Bay I Herald, that gentleman, being ut \Vuirurapa, is probably not aware that the notice fur the nomination has yet been published.
