Dr. Craig, one of the Justices, speaking tor the Bench, considered that as the road was in a disgraceful state, and the defendant was a medical man ' going about his work, and on this Occasion with ii wounded horse, lie could not very well do anything else. Taking the circumstances of the caso into consideration, the Bench would simply outer a conviction, without costs.
