APPEAL COURT.

(Per United Press Association.) WELLINGTON, July 10. In the Appeal Court, Judges Williams, Denniston, and S. M. Edwards, sat to hear an originating summons moved into the Court by agreement between G. P. Donnelly, of Hawke’s Bay, and the Commissioner of Taxes. The questions for the Court’s consideration arise in connection with the interpretation of section 56 of the Laud and Income Assessment Act, 1908. By her will, the testatrix devised to her husband (the plaintiff) all her interest in the Waimarama blocks, subject to certain conditions. These conditions were unfulfilled. The plaintiff’s present occupation is by agreement with the trustees until they should require possession thereof for purposes of sale, subject to payment of interest on certain mortgage monies secured on the properties. Messrs H. D. Bell and Lewis appear for plaintiff, and Mr. Solqowell for the Commissioner.
