APPEAL CASE. CROWN (Railway Dept.) v. CANTER'BURY STEAMSHIP COMPANY. In this appeal case, in which the plaintiffs were appellants, the particuars of the case have been fully represented in these columns. The claim was one for £16 10s. for demurrage on a railway truck, on which a stone crusher was consigned to Wanganui from Taihape to be delivered at f he rail of the s.s. Storm at Wanganui. The vessel being unable to lift the rrusher here, it was detained on the 'truck (not having at any time been taken within JSO yards of the vessel's rail), till arrangements were made to rail it to Wellington and there ship it. Mr. C. C. Graham, S.M., who decided the case in the lower court held that the rrusher, not having been delivered to (^e shin's rail, had not been delivered to the defendants in accordance with the agreement to carry the crusher, and crave judgment for the defendants. His Konor decided that the appellant had failed to establish that the decision of <^c Magistrate was erroneous in point of law. and dismissed the anneal with costs £6 Bs. to the respondent.
