PETHERICK v. HOBSON.
His Honor gave judgment in the above case, which was a claim by the plaintiff for the remainder of a contract for ,£360 — .£llß, for a house built by him for the defendant. His Honor said there was a difference of opinion as to what should be deducted for defects, and also of the value of the .house, hardly two experts agreeing in any one item. With such a conflict of. evidence it was hard to arrive at any satisfactory conclusion. Judgment would be given for the plaintiff for JE4B 6s. Seeing that the plaintiff climed =£118, and had not made good his claim, only partial costs — .£5 ss, and witnesses' expenses and diabursements — wore allowed. His Honor pointed out that he had visited the house, and certainy found very rough workmanship. The back door should not have been put up as it was, and other doors and the passage and several other things, certainly reflected no credit on the builder.
