The Floupmilling 'Case.

Continuing argument in the fictirinilling .case in the Court of Appeal, ccunsel for the defendant company submitted' that the' agreement was contrary to public policy, because of the tendency to limit the output and cntiancc price, and prevent the improvement of the quality of flour. As to the power of the company to take up shares, six propositions were submitted to bar this, chiefly on the ground that the company could not' part with the control of ita own business — a limit 'itsilf in any way; also, thatvthe directors ha'rl no power to conclude such transaction, which was 'out of 'usual ccurso.

The prosecution has been withdrawn against Pasley, a bank clerk, alleged guilty of the theft of .£l5O. WELLINGTON, October 29.
The claim of George Bodley, lodging-i-nuse keeper, against King Mahuta, for i'lß2 9s 6d, disputed balance of account for accommodating 75 Maoris during Mahuta's visit to Wellington fast year, was decided by the Stipendiary Magistrate to-day, plaintiff being non-suited, without costs.
