0, J. McCarthy v. Mrs A. E. Bcott, claim £107 Is 6d for furniture in Rutland Hotol, claimed by Mra Soott as " fixtures." After reviewing the " ancient histoiy of the Rutland Hotel," Mr Brobant, in giving judgment thia morning, said :— " In the oase I am deciding tho articles claimed were affixed aud paid for by various persons at different times, and thore is really no reason why they should bo declared to bo tbe property of Mr McCarthy rather than Mr Parsonn. while on the othor hand if tha Court compelled Mrs Scott to pay for these things it oppejrs ehe would have purchased (judging from Mr Parsons' etidence), a law Buit rather than hotel furniture. Tho judgment of the Court is for tho defendant, with costs." The costs wore as follows :—: — Court costs 4s, witnesses oxponaoa 275, and solicitors fee £5 7s.
