Sattjbdat, 13th Jahttaby. (Before Mr C. C. Kettle, R.M.) OOW TEBSrASSING OH THE BAII.WAT IIKB. John McGregor, of Matarawa, farmer, ■was charged on the information of F. Spooner with being the owner of a certain cow which, on December 15th, trespassed on the railway line of the Foxton-Wanga-nui railway, the said railway being then open, for traffic and veßtcd in the N.Z. Bailway Commissioners. Mr Marshall appeared for the informant and Mr Watt for defendant. Mr Watt admitted that the cow owned by the defendant did trespass on tbe line ten chains beyond the Matarawa station, but the portion of the line in question ■was not properly fenced. John McGregor, the defendant, said tho line in the vicinity was fenced and there ■was a gate (the property of the Commis•ionera) from his paddock leading on to the Ihe railway line. The gate at tbe time of the cow being on the line had sunk, and could be opened by the wind. The gate Was altered next morning. After argument by counsel as to construction to be placed on the by-law and the sections of the Public Works Act, judgment vras reserved.
Tenders close at 2 p.m. on Wednesday next for levelling tbe Bite for the new hospital. Specifications and sections at Mr A. Atkins's office. Captain Edwin wires at 1.18 p.m. — Northeast to north and west gale with rain after 12 hours from now; glass further fall. Sea considerable and increasing after 20 hours from now and good tides.
