THE APPEAL COURT.

The Case of Whitaker v. Hutnhison.

Wellington, April 27.

In the Appeal Court this afternoon, before Judges Williams, Denniston, and Connolly, the case of Whitaker v. Hutchison, was heard. This was an appeal from tho judgment of the Chief Justice refusing to strike out a paragraph in the defence in the action charging Sir Harry Atkinson and tho Hon Mr Mitchelson, members of 'the late Ministry, with being indebted to the Bank of New Zealand, and with having on that account confederated and collusively acted with the plaintiff, Sir P. Whitaker, their colleague in the Ministry, in assisting the Bank of Now Zealand in its financial difficulties to the prejudice of the taxpayers of the colony. Mr Bell appeared for the appellant, Sir P. Whitnker. the respondent, Mr Hutchison, appsaring in person. The Court adjourned at tho conclusion of Mr Hell's argument.
