Miss Sponce v Mrs Walker ; claim £6 5s for ono week's wages at £3 and £3 59 for expenses from Auckland.— Mr Hutchison for plaintiff and Mr Barnieoat for defendant. Mr Hutchison opened the oase for his client, stating that the question as to tbe payment of wjgts was one of fact, and that there had been an agreement between Miss Spence and Mica Walker for a six months' engagement at £3 a week, travelling expenses from Auckland to bo repaid hr.h >r. — Miss Spenco, plaintiff, gave evidence as a* to her engagement by Messrs Macky, Logan, Stceu & Co, of Auckland, on behalf of Mra Walker. After she had been here about four weeks Mm Walker gave up business and went to Wellington. Was five weeks in her employ, and had received payment for four week*' services— a cheque for £6 at tbe end of the first fortnicht, £3 in cash at the end of the third week, and £3 at the close of the next fortnight, leaving one week's wages due.— By Mr Barnieoat —The weak's wages whicn had been left owing were to be paid when Mrs Walker got to Wellington, to suit her convenience Mrs Walker never alluded to witneta' going to Wellington, but said she h<,d advised Mr Robinson to keep her. Witness had never said that she was willing to go to Wellington, or would rathor go there thi.a stay here. She preferred staying here ~o going to Wellington, though sho was getting a lower salary. The expenses were to lie paid when she got hare,— Mr J, J. Robineon, successor to Mrs Walker, gave evidence that he had made arrangements wiih Miss Spence to remain on, though he could not say whether Mra Walker was under the impression that she waa to go to Wollington. He thought at first from Mrs Walker that ho was only to retain her tiil Mrs Walker required her service*, and was inclined to think Mrs Walker desired to get rid of Miss Spence. Thii concluded the oiBO for the plaintiff —Mr Barnicoat, for the defendant, having opened the one, c tiled Mrs Walker, who stated that when she sold out she was prepared to keep Miei Spence on in Wellington, tut asked Mr hobinson to keep her for a fortnight till she was ready for her. Miss Spence asked her the last thing when going to Wellington to tnku her instead ot leaving her with Mr RobinsoD. t'id not owe her one week's wages. — Hy Mr Butohison : Had not brought hor books, but knew that she had paid Mi>s Sponco ia full.— By Mr Barnieoat : If she had owed Miss Spenoe £6 she could havo ptid it easily enough bsforu she went to Wellington.— At this stage Mr Biraiooat asked that an adjournment should be grauted to allow of the evidence of Miss Wilkinson being t»Ueu on several points mentioned, more particularly th c question as to whether Miss Spenoo pro. mised to go to Wellington, and whethe r tho £3 paid hor by Mrs Walker waf fujj payment of her wages to date. — His Wor » ship agreed to a remand, and the case wii' adjourned for 14 days.
