RESIDENT MAGISTRATE'S COURT.
, ; . Monday, November 20. (Before T. Bamber, Esq., and W. F. . Rnesell, Esq., J.P.s) DRUNKENNESS. Frederick Potto, against whom there are 15 previous convictions, was pned 10s or 48 hours 3 imprisonment for drunkenness. — Sergt Bissset stated that a prohibition order had been; obtained against the prisoner, and inquiries were being made which would probably iead to the discovery of the parties who served: the, liquor, when they will be proceeded against, T ' ASSAULT CASE. 1 T. B: Wilson, a cab driver, charged Thos. Hayes', a cab proprietor, with assaulting him on" Thursday last.— Mr Borlase appeared for the defendant. — Complainant deposed that on -Thursday last, about 7.30 in the morning, he was at the Rutland Hotel, when defendant drove his horse front of him; he! had his hands in his pockets, when defen-dant-got off the conveyance and struck him a blow on ihe nose, knocking him down ; defendant had used the most offensive language to him 1 during the, last few weeks; he had been in Hayes 1 employ, and during the time he 1 had bedn emploYed by him he had three accidents; defendant had not discharged him'} he left of lus own accord ; the only way that he could account for the assault was that he went to station to meet the morning train, and defendant did not like it. — James (Jolemap, in the employ of Mr Caddy, said he Was in the shop and Baw Hayes get off his cab and knqck Wilson down ; he had heard Hayes : abuse complainant several times, Wiltaa gave no , provocation to defendant ; he c_6uld notf hear anything said as he would :be^6o yards away; Hayes drove up right' iniront of Wilson, and after striking the blow he remounted the cab and drove away.— Hayes said that he had taken some luggage from the Jutland Hotel and again returned for a passenger, when a man asked hint how it was that he and Wilson were on such bad terms ; he answered him, and told him to mind his own business; when he came out of the hotel he laid; he was ready to speak then, when Wilson immediately put in his word, saying that he would speak to no one and at the same time touched him oh the nose. He then struck him and knocked h'itn down. Complainant had been drunk on many an occasion; while in his employ and he had sustained a large amount of damage in consequence. He had received great provocation.— Mr Bamber said that it was proved to the satisfaction'of the Court than an assnlt had been committed therefore a fine of 40s amd costs would be inflioted.
