MEETIING OF CREDITORS.

Pursuant to advertisement a meeting of Creditors in the estate of Nathan and Wilkie was held on Tuesday at the Court House. Present: — Messrs J. Duthie, (also aa representing J. and C. Bull, Nannestead & Co, and Bartholomew & Co), G. Nathan, H. Williams, Xno. Wilson, W. D. Shaw, Lash, J. Olark, C.S. Cross,. J; Lamont, and Mr Jas. Broun, (trustee). Mr Duthie in the chair. In answer to questions put by the Chairman and by the creditors, the Trustee said there was a credit balance in the estate of £438. That a sum ; of over £1000 had been received from, the Government, but Mr Hodge had 1 retained £660 which he -refused to give up alleging that he had a Hen upon it. The money had got into Mr Hodge's hands in conseqiienceofit being paid to his agents in Wellington by the Government. „( M r Hodge had received it in trust but Reclined to pay it over. In reply to further questions relative to the bill of costs, Mr Brown said he had received one. Mr Hodge had applied to have it returned, but he (Mr Brown) acting under a solicitor's advice, refused to give up the bill. The Trustee then at the request of the Chairman placed the document on the table. The Chairman stated to the meeting that the total shewn as. due to Mr Hodge was £827, but he had received on account a sum of £269.

Mr Dawson (clerk to Mr Hodge) stated that Mr Hodge Had offered to allow his bill to be taxed by Mr Woon, bat that gentleman had declined to undertake the duty, as it was principally for items oatside the District Court* . Mr Hodge now most emphatically declined to allow, hit bill to be taxed at all, and that the amount (£660) retained by him was all due. Indeed a writ had been issued for the payment of . the bill in full. Mr Hodge, however, was willing to submit his bill to the approval of any two legal gentlemen for inspection. The creditors must remember , it contained the, costs 'of no less than four, actions, and that although it appeared large, yet upon investigation it would be found to be perfectly fair and reasonable. "•

Mr Brown said the payment of the money by Government was conditional on the olaims of the men who , had obtained judgment against the debtors, being satislied to the extent of one month's' wages/ Mr Cross asked whose fault was it that the costs in one of the actions brought by the Trustee had been bo much increased by neglect in having the case set down. Mr Brown replied' that at the time mentioned there was no money in the estate, and that it required some guarantee from the creditors before personally incurring expense. Delay in oase had been caused by some flaw in' the legal preliminaries. '\ ' ' '■' [ After some further diaoussion it was proposed by Mr Limont and seconded by Mr Clark— That- Messrs Duthie, Cross, and Shaw be appointed supervisors of the estate, and that the Trustee take no action without their advice*" Carried. The meeting then separated.
