THE HARBOR BOARD.

Mr Churton has received the following reply from the Superintendent ; — Superintendent's Office, Wellington, 28th Jan. 1876. Sib, — I have the honor to acknowledge the receipt of your letter of the 15th December last, forwarding a memorial from merchants and other residents in Wanganui, requesting me, with the consent of the Council, to constitute a Harbour Board for the Port of Wanganui, and to make the necessary laws for the guidance thereof. I should have been glad to accede to tho wishes of the memorialists, but lam advised by the Provincial Solicitor that the Harbour Boards Act; of' 1870 only confers the power of making laws for the constitution of Harbour Boards on the Superintendent and Provincial Council of any Province, and that the Abolition of j Provinces Act does not confer on the j Superintendent of any Province the power' to enact laws, with tho consent of the Governor in Council, but only the power to exercise all powers, duties, and func-. tions which, immediately before the pass- 1 ing of the Abolition Act were under any law vested in or to be exercised or per- 1 , formed by the Superintendent of any' Province on the recommendation or reso-j lution of the Provincial Council of such' Province, under any law or ordinance for! the time being in force, with the consent of the Governor in Council. , The Napier Harbour Board Act, passed; during tho last session of the General As-j seinbly, would form a good model, pni which an Act could be drafted, to be in-j troduced into the General Assembly next session. > I have the honor to be, Sir, ' Your obedient servant, William Fitzherbert, Superintendent. < E.
