RESIDENT MAGISTRATE'S COURT.
Monday, Dec. 20, 1869. (Before Walter Buller, Esq., R.M., D. S. Durie, and Thos. Powell, Esq_., J.P.'s). William Warwick was fined 10s and costs for allowing a horse and spring cart to remain on the street, without a person being in charge. The defendant said he had left the horse for a few se conds to settle an account. BREACH OF TRIGONOMETRICAL SURVEY ACT. Henry Jackson v. Alex. McDonald. Mr Buller said he retired, in this case, voluntarily from the Bench. Mr Roberts appeared for the prosecution. The defendant applied for an adjournment of the case \intil to-morrow. He had received the summons on Friday evening, and had no time to procure legal advice. Mr Roberts opposed the adjournment for more than a few hours, urging that the Government would be put to inconvenience, as Mr Jackson had a number of witnesses in attendance. The defendant said it was much more important that an individual should not suffer, than that the Government might he inconvenienced. The bench decided to adjourn the hearing of the case until to-morrow at 11 o'clock.
