RESIDENT MAGISTRATE COURT.

Tuesday, November 5. (Before Joseph Giles. Esq., E.M.) Marromatis v. Gallaghar—Claim for £l3 15s. This was a disputed account. Plaintiff had sold defendant some potatoes and a keg of butter. For the potatoes he charged 16s per hundred pounds, aud the keg was supposed to contain 301bs of butter. Defendant stated that ho bought the potatoes according to the usual trade custom, at the rate of £l6 per ton, or 10s per cwt., and that the butter was short in quautity. He had paid a proportionate sum into Court, for which judgment was given, and also for 16s 6d the value of the empty bags ancb-keg, unless the same were returned within one week.

William Patterson v- Theresa Gething—Claim for £3 13s Gd, balance due for rent. Defendant disputed the amount as being in excess of rent agreed to be first paid, and denied that any notice had been given by plaintiff of an increaßed rent. Plaintiff was

not prepared with proof of notice, and judgment was given for 22s and 9s costs.

William Chambers v. John Hall— Claim for £lO. Judgment confessed. Order made for payment by £1 monthly instalments. Patterson v. M'Kew—Claim for £1 18s, for goods sold and delivered. No appearance of defendant. Judgment for amount claimed and costs. T. Dickinson v. H. Barcle—Summons to show cause why previous judgment remained unsatisfied. Defendant pleaded that his average earnings were not sufficient to allow him to satisfy judgment. The plaintiff was not prepared to disprove this. Summons dismissed.

Ryan Bros. v. Peter Ferguson— Summons to show cause why a judgment given in the Cobden Court remained unsatisfied. Defendant had paid £l, but pleaded insufficient earnings to satisfy full demand. He admitted that he was now earning 12s per day. Order made for payment of £1 per week.

David Moir v. James Coomb—Claim for £3O 15s. No appearance of defendant. Judgment for amount claimed and costs. AVilliam Graham v. Juo "Ward—Claim for £1 Bs, expenses incurred in journey from Addison's Flat, as subpoenaed witness in the case Ward v. Hughes. Two days attendance and mileage. Judgment for the amount claimed and costs.
