ANIEL M'LEO D, of Westi-oet, in the Photince of Nhson, Conteactoe, having been authorised under Clause XI.I. of "The Goldfields' Act, 1806," to construct a Wharf'on the North Bank of the Buller Ever, opposite Kennedy-street, is hereby authorised to charge not exceeding the undermentioned Tolls on the said Wharf, for a period of Five Tears from the first day of October, One thousand eight hundred and seventy, on the following terms and conditions : 1. That the said Daniel M'Leod shall maintain the said wharf in good repair and condition during the said term, and pay a rental of five pounds per annum to the Warden of the district, or to some other person authorised by the Superintendent to receive the same. 2. The wharf shall be subject to the provisions of the Harbor Regulations which may from time to time be in force in the Buller river. 3. Should the Government consider it necessary for the construction of protective works, or for any other public purpose, the Superintendent shall have power to cancel this protection at any time ; and the said Daniel M'Leod shall, in that case, be paid the value of the wharf at the time of such cancellation, but the said Daniel M'Leod shall not be entitled to compensation beyond the actual value of the structure, which will be ascertained iu the usual way. 4. The Warden of the district shall have power, on being satisfied that the wharf i* not maintained in a good state of repair, or that any of the above conditions have not been carried out, to suspend the operation of this protection until the matter of complaint be removed, and if not removed within a reasonable time the Superintendent may cancel this protection. 5. In the event of this protection being cancelled under the provisions of clause 4 hereof, the said wharf, with all fixtures thereon, shall become the property of the Provincial Governincut of Nelson, and the Superintendent shall have power to take immediate possession thereof on behalf of the Province, and the said Daniel M'Leod or his assigns shall not in such case be entitled to any compensation. SCHEDULE. s. d. Goods, per ton 2 6 Horses, each 5 0 Cattle, each 4 0 Sheep, first 50, each ... 0 3 Do, over 40, each ... 0 2 Packages and parcels, not exceeding five cubic feet 0 6 Vessels lying alongside the wharf— Not exceeding 20 tons, per diem 10 0 Over 20 tons, per diem ... 20 0 If any vessel lying alongside the wharf shall receive or discharge goods or stock otherwise than from or upon the wharf, half wharfage may be charged on all goods or stock so received or discharged.
