WARDEN'S COURT.
(Before J. Giles, Esq., Warden.) An applicatios for amalgamation was made by Alexander and party, : Moles and party, and Sutherland and party, all working at Giles Terrace. After putting some questions, and reading the Surveyor's report, the Warden said that he wa3 not disposed to grant any amalgamation of parties without strong grounds. Application had previously been made by the same parties and had been refused, faking the strict letter of the law, both parties had rendered their claims liable to forfeiture. It was decided otherwise because their tunnels were not in. At the same time the parties had all alonghad been rather near going over the line which would cause a forfeiture of their claims. In that action it was expressly established by the Court that as soon as gold was struck, each party of four men should separate and work their own claims. They stated then that they could do so, and had done so. They now applied again for amalgamation. If the grounds of application had been the same as before, he should have refused it. But the ground now taken was a new one, and it had certainly had a good deal of force. It was confirmed by the Surveyor's report, which said that it would bo impossible to make two paddocks, situated as the claims were, and in consequence of landslips which had occurred. These landslips were things for which, of course, the applicants could not be responsible. He • wished it to be uuderstood that, in ordinary cases, he wasalways very much opposed to amalgamation, unless some ■! extraordinary reaso'n were shown. In this case amalgamation would be • granted.
