HORSEWHIPPING CASE.

DISMISSED WITHOUT PREJUDICE,

(By Telegraph—Press Association.) NEW PLYMOUTH, Wednesday.

When a horsewhipping case was being heard in the Police Court this morning the question arose whether tlia magistrate could hear the case, in which the charge is one of causing actual bodily harm. Counsel urged that the magistrate must either dismiss the ease or send it to the higher court, but tho magistrate wished it reduced to a charge of common assault, so that the Police Court could deal with it.

An adjournment was made to enable tho magistrate to consider the point raised. On resuming the magistrate dismissed the. case without prejudice.
