PETERSON v. LONG.
Frank Peterson, plumber, proceeded against W. Hugh Long, butcher, for possession, of a house in Pine street, Which had been sold to a purchaser (Mrs Renncr), who required the house for hoi: own occupation.
Mr R. McKenzie appeared for plaintiff, and Mr W. Noble for defendant.
F. C. Bird said lie had negotiated the sale of the property from Peterson to Mrs Kenner. The agreement of sale and purchase was produced.
Mrs Kenner said that she purchased the property for her own occupation. Neither she nor her husband owned any other property.
Mr Noble raised the point that the transfer of the. property had not been ..oaiplttcd within ono month from the agreement to purchase. This provision had been inserted in the war legislation to prevent bogus sales.
Pis Worship it was uofc ]ikfll ■ that a tenant would complete tho transfer until ho got possession of the property.- However, as the point wa3 of somo importance ho would give tho matter consideration, and would give his decision to-morrow morning.
