(By Telegraph—Press Association.) WEST PORT, Monday.

Mr Stout, S.M., this morning, on a technical point, dismissed the case against the Millerton Miners' Union regarding an unlawful strike.

The Magistrate sai'd the cause of action set out in the statement of claim, and tho ono to which the defendant union was called upon to plgad, was not the ra,use of action in support of which the plaintitl" appeared, and called evidence, nor was it the one for which a penalty of l'L'o is provided.
