HEAVY TRAFFIC BY-LAWS.
A Court Prosecution
The Defence Raised.
At the Hunterville Court the County Council sued Ewen McGregor for breach of its by-law relating to heavy traffic, by conducting heavy traffic on Mangao-nobo-Ohingaiti road without a license. Mr Miles, of Fullerton-Smith and Miles, appeared for Council, and Mr Esam for defendant. Evidence was given as to the facts, and Mr Esam contended that the by-law was bad on two points. The first of these was that it had been made tiu respect to the whole of the roads'in the county, and as some are Government roads the Council had thus exceeded its jurisdiction. This was overruled by the Magistrate, as the word " road" in the by-law was defined to mean road under the control of the Council. The second point was that the by-law also contained a provision closing all roads against heavy traffic during May, June, July, August and September. Mr Miles contended that the section under which the case was brought was separate from the one relating to closing of roads, the Council having a discretionary power. A fine of .£3 and costs was imposed, security for apneal bsing fixed at £10 10s. •
