T. A. Lyons vE. Meredith-Claim, £G lis 3d, commission on the sale of 700 sheep. Mr Beard for the plaintiff and Mr Bunny for defendant. Plaintiff gave evidence to the effect that in consequence of an interview with defendants'son, Mr Montagu Meredith, he saw defendant in April last, and arranged with him to sell 700 store sheep for him. He sold the sheep to Mr Perston at the price named 'by defendant, namely, 7s Cd per head, and now claimed commission at the rate of 2£ per cent. He had been a dealer in stock in Canterbury and Wellington for the past seventeen years, and thousands of sheep passed through his hands. He was in the habit of doing business of the kind described. He helped to drive the sheep in question from Riversdale to Mr Perstoii's place, and got paid 12s a day for that. He was for some time in the employ of the Gear Meat Company. For the defence, defendant denied that .he ever had any dealings through plaintiff, whom he recognized merely as a drover. Plaintiff introduced Mr Perston to him as a purchaser. He .did not remember having the interview with'plaintiff which hae been described,

Mr Bunny gave notice of appeal, J. Ewington v J, Ross.-Claim £l9. Plaintiff's son worked for defondant, haying been put on trial with a view to being apprenticed as a wheelwright. Defendant did not find him very satisfactory, but kept him on for nineteen weeks to give him a chance, and then dismissed Defendant paid into Court the sum of £6 llis Gd, being at the rate of 7s Cd per week.

Judgment was given for £llßs, being at the rate of 12s per week, and costs,
