Archibald Campbell v. Neil and Cook' erv.—Claim £l l4s, wages.
Mr Parker for plaintiff and Mr Bmmy for defendants,
The evidence showed that plaintiff an 1 hiti son 'vere employed on a contract fur fencing taken by Mr Love. Tho latter failed to carry out the contract, and according to plaintiff Cookery asked him to finish fenc'ng and be would pay them from the commencement.
Defendant's case was that they nevtr agreed to pay wages to Campbell, and that Campbell merely earned out Love's contract, . .-.■■.. •
It was alleged by plaintiff that out of the 22 days Claimed for he had been working ten days for Love, but that Cockery agreed to pay his wageß from the time he began. His Worship ruled that a verbal agree•ment to pay wages due under a contract by? another could not be held binding. Verdict for defendant
