Mr Quick appeared for the complainant, and Mr OHivier for the defendant. Complainant stated that lie went jnto the Chronicle office on business, and during the course of conversation was struck on the temple by defendant. ■ ■' Defendant stated that complainant came into the publishing office of the Evening Chronicle; and said he had been summoned .by Blundejl, Witness replied
that he'had nothing to do with Blundell, and requested complainant to leave the shop. He would not, and became very abusive. . Witness then threatened to send for a policeman to have him ejected. Complainant then made use of very filthy language. Plaintiff was put out, quietly at first, but persisted in returning. Defendant then struck him. Previous to being struck complainant put himself in a fighting attitude. His Worship said there was no doubt that Valentino had been a very great nui.sance. He was under tho influence of liquor, and did not appear to have any recollection of what took place. His Worship thought that defendant had used more violence than was absolutely necessary. At the same time theie was no doubt he had been subjected to a great amount of provocation. Under the circumstances lie would fine him 20s and costs.
