PXB FBESS ASSOCIATION —COPYRIGHT CHRISTCHURCH, March 19. The prosecution against a member ol the Pioneer Sports Club, for motor cycle racing on North Beach was dismissed as the foreshore below highwater mark is not a public place within the meaning of section 2, of the Police Offences Act, 1908. The defendant was Leonard* Poore, and the charge was that on January 12 he furiously drove his motor cycle on North Beach.
Mr Wyern Wilson, S.M., in his reserved judgment, given to-day, said the racing was held on a portion of the beach which was not vested in the New Brighton Borough Council for recreation purposes. It was not a place of public resort, open to, or used by, the public as of right. Prima facie, the Crown was entitled to every portion of 'the foreshore. In New Zealand, matters pertaining to the foreshore of these islands were administered by the Ministe" of Marine, and the public had no legal right to the use of the foreshore. The Pioneer Sports Club had obtained the consent and approval c.f the Marine Department to the holding of the races, and defendant seemed to have been doing no wrong in competing. ■ WELLINGTON, March 19. It is understood that as a result of a conference between the Minister of Railways and the Executive of the Amalgamated Society of Railway Servants, an agreement has been come to between the parties for the setting up of a Wages Board, to which the matters in dispute will be submitted.
