The Magistrate’s Court- was engaged to-day on an’ interesting case in which George Morrison ’ (blacksmith) claimed from Stanley Sharp' (hairdresser), the sum of £5O 'paid by Morrison to Shanpl, as stakes Sn a -wager ion the result of the general election in St-at-ford. Morrison claimed that Sharp- paid elver th e money contrary to his instructions. Counsel for the defence contended that, pilaintiff Was precluded fc-om bringing action by toe last words of Section 70 of the Gaming Act, which sets out that np aett'on can be brought in respect of moneys “wen, lost, or staked” on any wagering transaction. Counsel for pilaintiff contended that, the transaction between Morrison and Sharpi was not a wagering transaction, trtt only an ordinary contract between pufncipal and agent. Counsel for pilaintiff also-held that, the words quoted meant more than was conteined in Secfion 69, and that therefore the ’New Zealand Act was similar to . the Eing-iieh Act; and toat the decisions under the English Act gave plaintiff the right to’ bring the action. Decision was reserved for a fortnight. . . ,
