Magistrate's Court. (Before Major Keddell, S.M.) Thursday, August 2.

Mary O'Shea v. Wm, O'Shea. The defendant was charged wifch deserting his wife and four children, under the age of fourteen. Mr Hamilton for the plaintiff, said the parties had come to an arrangement, defendant having promised to live with his wife and sup. port his family, and he ask«d that tha case urighs be withdrawn. This wai allowed. Waimate Borough Council v. Waimate Industrial Co-operative Association, Limited. This was a charge of infringing a by-law, heard on the previous Court day. The Magistrate now dismissed it, and allowed £1 la solicitor's fee, holding that a permission had been given by the Council sufficient to bar them from taking proceedings, but he expressed surprise that two corporate bodies should have conducted their negotiations so loosely, and that instead of verbal communications, they should have been in writing. He held moreover that the by-law itself was bad as not being properly set out in the special order, and no time being fixed for its coming into force. Richard Hutt v. Stephen Boreham, claim for arrears of rent and possession of premises. This case had been partly heard at the previous sitting, and after some further evidence judgment was given for £5 11s 6d, and costs, and defendant ordered to give up possession within seven days. John Davis v. William Wrathall. Mr Hamilton for plaintiff, and Mr Clement for defendant. An application for costs of a special day on which plaintiff had asked for an adjournment without allowing sufficient time for defendant to 3ountermand his witnesses. After hearing evidence, an order was made for jG2 18s 9d. Judgment was given for plaintiffs in the following debt cases : James Meehan y. James Ferguson, 17s 3d, and costs sa ; Priest and Holdgate t. William Hoare, £9 12s, and costs 9s ; same v. Matthew Peck, £3 Os 7d, and oos'ts 9s : Trustees of Peter Dooley deceased, v. Michael Burke. £Q 13s 6d, and costs £1 15a 6d; Bob'.rt Brain Y. Boberfc Dowie, and eosti 11s.
