It appeared on the sth of May last defendant was found lying on the Tara-dalc-road; having' either fallen or been thrown, from Irs hqrse. He was conveyed 'to the Napier lock-up, charged i with drunkenness, and the arresting j constable deposed that Ross was undoubtedly drunk. The fall cansed injuries v/hich Dr Innes was called to treat. Dr Innes topk the stand that pnder rule , 137 of the society's laws defendant could • not claim to be treated as a club patient, the injuries having been received while he was drunk. This defendant denied, ; assorting that his fall was due to some ' sudden seizure. After hearing the" evidence his Worship gave judgment for the amount claimsi, wit)i coste arid expenses amqunting to £1 19s.
