IN BANKRUPTCY.

Wednesday, March 6. (Before his Honor Judge Weston.)

His Plonor took his seat on the Bench at half-past nine a.m.

IN EE THOMAS QUINS.

Mr Hawkins for the bankrupt, applied for an order of discharge. The bankrupt was examined at considerable length. His Honor said tbis <vas a case ot a man bein<* persuaded to en!:or into business at Kumara. Messrs Smith and Barklej', drapers, of Grey mouth, supplied him with «oods, taking a bill of sale over everything he bad or might have. Knowing his precarious position, and that he was at the nidrcy of Smith and Barkley, he opens an account with Messrs Li-'htband and Co., ot ChrHtchurch ; does not pay them a farthing ; and Messrs Smith and Barkley walk in. When a man makes over every■hino and is at the mercy of o'ie firm in die et diem, his con d act must b? looked upon as abominable. Certainly the bankrupt's liabilities were not heavy, but to mark the Court's sense of his con luct, the certificate of discharge would be suspended for one year. He hoped the trustee would take advhe as to whether Messrs Smith and Barkley could collect thd bankrupt's debts themselves.

IN THE MATTER OF J )SHUA GIBSON.

This was en adjourned application by Mr Purkiss, on behalf of Mr Alfred NJorman, who claimed to rank as a creditor for £56 in Gibson's estate His Honor having real over the evidence given by Mr Norman, said the question was whether there was any agreement between Gibson and Norman. He gave bis decision with reluct: nee, believing that Mr Norman had a gool nural right, but a moral right was not always a legal claim. He could not see that there was any contract for a partnerihio, or that the work done by Norman was done in pursuance of a contract. With great reluctance he must disin ss the application, but without costs.
