Nelson, April 6.

Sir David Monro's action against Messrs Luckie and Collins, of the Colonist, for an alleged libel published by them, was argued to-day, on the applicaticn of Mr Pitt for Connolly on the behalf of said David Monro for a rule to make absolute. Mr Fell, on the part of Luckie and Collins, opposed and raised preliminary objections as to the insufficient proof of the publication. Mr Fell cited numerous cases, and the Judge ruled on the case of the Queen v Baldwin that the rule must be discharged. The costs were not allowed as points of a technical character arose. The action for libel aaose from the insertion in the Colonist of a statement that Sir David Monro in 1862 had put back the clock of the House of Representatives for the purpose of carrying a party measure. Messrs Fox and Luckie filed affidavits in reply, which traversed the affidavit of Sir David Monro, but they were not read in Court.
