RESIDENT MAGISTRATE'S COURT,
GREYMOUTH. ' (Before W. H. Resell, Esq., R.M.) Thuesday, Mat 28. Lucas v. Usher (Nelson Coal Company). — Judgment was reserved in this case, heard on Tuesday, and reported in our Wednesday's issue, Mr Guinness appeared for the defendant, who was not present The Magistrate said that as Mr Usher, the Manager of the Company, had accepted Mr Lucas's tender in writing, he had thereby accepted it. He had put an addition to the acceptance that Mr Lucas was to meet him as early as practicable the morning following the making of the tenders. Mr Usher was aware, however, that Mr Lucas was going to the coal mine, and could not come •early ; he had arrived, however, before the bank closed, and in business hours. I, therefore, think the agreement binding, and I consider plaintiff had a good and just cause of action in this Court ; and, taking into "consideration the monopoly he would have enjoyed in the boating of the coals, I give judgment for plaintiff for full amount (L1U0) claimed and costs. Mr Guinness, for the defendant, gave notice of appeal. Cohen v. Jordan and Co. — Claim for Ll9 15s 3d, for goods supplied. Judgment by default. George Gilmer v. Lyndon. — Claim for five weeks' board and residence. Judgment by default for full amount claimed and costs.
The Court then adjourned until tomorrow, at 10 a.m.
