PRESIDENT MAGISTRATE'S COURT.

(Before &. G-. FitzGerald*, Esq., E.M.) Saturday, September 14.

Drunk and Disorderly. — Harvey Huntley was fined LI, or in default eight-and-forty hours imprisonment. Breach of Police Ordinance. — The adjourned case against William Thompson and William Cristian, for excavating beneath the surface of the road, was called on. Sergeant Sugrue stated — that he* had measured the distance between the excavation and the river bank, near Mr' Abbott's house ; it measured a little over ninety feet. Mr Broham here produced the gazette containing a proclamation notifying that all lands within two chains of rivers (on the West Coast), navigatxle for boats, shall be reserved for the purpose ot public roads and wharves. Mr Harvey contended that the river was not at the present time navigable for boats, and further that the Magistrate had no jurisdiction. The case should have been brought in the Warden's Court, at Kanieri. His worship fined the defendants LI each with costs, Mr Harvey gave notice of appeal. Assault. — Fanny Moore, arrested on a warrant for failing to appear to a summons issued on an information laid by Hannah Pickles, was liberated on the application of Mr Bees. The case was adjourned till Monday, in order that the defendant might be able to subpoena witnesses.

CIVIL CASES

Taviner v. Hokitika and Greymouth Tramway Co. — Li this case his worship gave judgment for the defendants. Solomon v. Solomon. Adjourned till 10th October.

The Court was adjourned till eleven o'clock this day.
