(Before Michael Keogk, Esq., Warden.) Reilly and Party t. Smith and Party. — Ike plaintiffs stated that defendants had encroached on their claim at Pretty Woman's Gully. Case adjourned from ?% » ad i° um ed till 6th instant, at btaiiord Town, for assessors to view ground. Plaintiffs to receive compensation for any estimated damage done by drive marked broirn on Surveyor's plan. That portion of encroachment marked yellow not to be taken into account, this trespass having occurred previous to occupation by plaintiff. Grevellan and Co. v. Williams and Co. — Encroachment on claim at Piper's. Judgment for defendants, with costs of Court, Plaintiffs to hold from original pegs, alld Surplus ground to be given to defendants on upper boundary.
STAFFOBD TOWN. Friday, September 6. Morrison and party v. Herring and party. — The defendant was summoned for depriving a portion of German creek of its water. Judgment for plaintiff. Defendant fined L 5 with costs of court.
Reilly and party v. Smith and party. — Encroachment on claim at Pretty Woman's. Verdict for plaintiff, with LlO damages. Assessors — J. Gillam, John Garner, John Havelbrath, and John Barrett.
Grant and party v. Carr and party. — Holding surplus ground, depth of sinking not reaching fifty feet. Judgment for defendant with costs of court.
Achilles and party v, Garner and party. Case adjourned from 3rd September, The defendants were summoned for objecting to complainants working claim atßallarat. Judgment for plaintiff with costs of court. Peg in dispute of extended claim to be replaced in original position. - Care to be taken in sinking plaintiffs shaft, and equally so in their drive, so that no injury result therefrom to defendants tunnel.
