RESIDENT MAGISTRATE'S COURT.
(Before G. G. Fitzgerald, Esq., R.M.) MoxDxVY, Deccjiber 10.
Druxkexnes*. — Alicia O'Niel, Henry Bowen, Evan Morgan, and Alexander Smith* were respectively fined 5s for this offence, in default of payment, 24 hours' imprisonment. IxoECENcr. — Alexander {Smith was fined for this offence in the sum of L 2, in default four days' imprisonment ■with hard labor. Breach o^ the Peace. — George Durham, David JVfullin, William Clark, and Thomas Clark were each charged with committing a breach of tht peace within view of a couslable, and the same being clearly proved, they were each mulcted in tho sum of 20s, in default four days' imprit-onment. Refusing to Pay Passage Money. — Robt. Graham was charged with refusing to pay for his passage per p.s. Bruce, from Okarita to Hokitika. After hearing the evidence, his Worship ordered him to pay LI, with the alternative of four days' imprisonment in case of non-payment.
Larceny. — Daniel Conuell was sentenced to one months' imprisonment, with hard labor, for the larceny of a gold chain of the value of L 5.
Obtaining Moxey under False PreT£> r CES. — Jolm Beach was charged with obtaining money under false pictences, and on tho application of Inspector Broham, ho was was remanded till the 17th instant. Bail was taken, himself in LSO and two suroties L 25 each.
Embezzlement.— William. Phillips, charged with this olfeuco, was remanded till tho 17th mst.
BuEGLAiir. — James Moriarty was further remanded on the charge of burglary till tho 17th rust.
Conspiring- to Murder. — Wm. DeLaccy surrendered to his bail, charged with conspiring to murder one Edward Burton Fox. Mr South said that ho would have to ask for tho remand of the, prisoner till Wednesday next. Mr Button stated that he had no objection to the remand, provided the prisoner wcro released on his former bail, and ho (Mr B.) woidd submit to the Bench that this charge had now been hanging over his client's head for the past six months, and that he had never made any attempt at effecting his escape, but had, on the contrary, always appeared to his bail. Mr South replied, alleging that, for tho ends of public justice, it was necessary in the case where a prisoner was called upon to answer such a grave charge. that he should rarely be let out ou b.iil, save where there was some delay ou the part of the Crown. His Worship said that he could not admit tho prisoner to bail, hub would remand him as requested. DeLaccy was then takeu to the Camp. Lunacy. — William Smith, charged with being of unsound mind, was, on the ovidence of Drs. Riley and Beavan, committed to the Sutmyside Asylum, Christchurch.
