RESIDENT MAGISTRATE'S COURT.

(Before G. G. FitzGerald, Esq., R.M.) Wednesday, October 24.

Drunkenness. — William Murray was charged with this offence, and fined ss, or, in default of payment, 24 hours' imprisonment. — Robert Oliver was fined 5s for drunkenness, and 15s for disorderly conduct.

Breach of the Peace. — John Calvert was charged with this offence. The apprehending constable deposed that the prisoner Jftad struck a man in his (witness 1 ) presence, without the slightest provocation. Wni. M'Kay was then called, and bore visible traces of having been subjected to most brutal treatment, He deposed that the prisoner had beaten him inside the Shakespeave Hotel, and had then followed him to the street, where he again commenced when the constable caused him to desist. His Worship fined him Ll, or, in default of payment, 48 hours' imprisonment. Vagrancy. — William King was charged with having no visible means of support.

Detective M'Guire, being l sworn, deposed that he had frequently seen the pri» soner, and had known, him for about the the last six ,njonths ; Ms associates were thieves and characters of the worst description. Detective Brown, being sworn, deposed that he had frequently been to the prisoner's tent, and invariably found him drunk. The prisoner, ,in his defence, stated that he had recently been working at the launching of the steamer Persevere, and tbat there was a sum of nine pounds owing to him in respect of such work. He asked fot. a remand, in order to obtain witnesses. His Worship woul^ remand prisoner till to-morrow morning. He would, however, remark, that it was but very recently he had been discharged from gaol for larceny. Assauliing a Constaiu/b. — Henry Kelly and Johanna Eichanls were 'barged with this offence, and, from the evidence, it appeared that some females had been creating a disturbance iifttbe house of the female prisoner, and that Kelly had, with some violence, ejected them, and that they had procured the attendance of a constable and given the prisoner into custody, whereupon both the prisoners struck and assaulted the constable. His Worship sentenced prisoner Kelly to one week's imprisonment, ami prisoner Richards he would fine in the sum of L 2, or four days" imprisonment. The fine was immediately paid. Assault. — These prisoners were charged with assaulting Margaret Mnloney, and the charge being proved they were fined respectively* in the sum of LI, or in default of payment, forty-eight hours' imprisonment.

CIVIL CASES.

Gordon and Burnes v. Home.— His. Worship delivered jndgment in this cate this morning, and recorded a nonsuit. Clarke Bros. v. Hiskings.— This case was adjourned the other day, to procure the attendance of Mr Eaton, a clerk in Mr Sale's office, and after having his evidence, his Worship gave judgment .lor amount claimed and costs".

Bee v. Morris. — This was an action for goods sold and delivered. The defendant did not. appear. Judgment by default for plaintiff for amount claimed and costs. M'Beath v. Roberts. — Action to recover value of goods sold and delivered. No appearance of defendant. Judgment for plaintiff for amount claimed and costs. Murray v. Smith. — Action for money due and payable for wages, and also for cash lent. Judgment for amount claimed and costs.

Madilon v. Jollie. — This was a claim for money due for board and lodging. Mr Button for plaintiff ; defendant in person. There were only the parties to the action examined, and, his Worship gave judgment for plaintiff for amount claimed and cbsts.

White and Pile v. Arnett. — Dismissed' on account of non-appearance. Lazarus v. Cleve. — Mr Home applied for a re-hearing of this case, which application Mr Button opposed, and after argument, his Worship refused to grant a rehearing. v

The Court then adjourned till 11 p.m., this day.
