Thursday, Aror3T 9. (Before J. Poynter, Esq., Resident Magistrate, and a full Bench of Magistrates.) On Thursday morning, the four prisoners, Burgess, Kelly, Levy, and Sullivan, were placed in the dock, in the Magistrate's Court, on the charge of having murdered James Battle, on- the 12th of June last. Notwithstanding it wa3 pouring rain in torrents, tho Court was crowded. The first witness examined was Sergeant- Major Sliallcrans, who, being sworn, said : I received information from Sullivan, on the 28th June, that he wished to communicate something to me. I afterwards saw him, and had some communication with him. He ma 'c a statement relative to Battle's murL*r. I took it down. Mr Pitt objected to tho statement of Stillivan to Mr Shallcrass being brought as evidence against tho other prisoners, as it had been elicited by tho promise of a reward from tho Government. Examination continued : Previous to making hi 3 statement, I bold out no promise, inducement, or threat ; on the contrary, I cautioned him that whatever he told me would be takon down in writing, and might be used as evidence against liim. He said, 'I am awaro of that ; but I wish to make a statement.' He made the following statement, which I wrote down.
