The only vessels on the berth at Melbourne for Hokitika, are the Tararua s.s., and the John and Jane ; the former to sail on the 10th inst., and the latter early. We are informed » by the Melbourne "Argus" of July 2nd, that the schooner Moyne sailed thence for Hokitika on June 30th. The " Westland Observer," July 7, informs us that the schooner Caledonia, from Dunedin, arrived off this port -yesterday, and remains at anchor, waiting a favorable wind. As yet, there is no appearance of the Flying Squirrel, although she sailed from DuneJin before the Phoenix, which has arrived here, discharged, and prepared for sea. The Court of Common Picas ha 3 just delivered a judgment in a case of average in connexion with deck-loading, to which we invite the attention of our readers. An action had been brought last term, but, as the case presented peculiar features, the parties agreed to state a special case for the opinion of the Court, and the judgment referred to was delivered on the case so stated. The i plaintiffs are the owners of a ship named I the Shooting Star, and the defendant is a I London merchant, who, in May, 1863. chartered the plaintiffs' ship 'to load at Quebec a complete cargo of deal», including a deckload, for delivery hi the port of London. After leaving on her homeward voyage, the Shooting Star encountered very severe weather, and portions of the deck cargo were jettisoned on two separate occasions, as alleged in the captain's protest, " for the safety and presorvatio n of the said ship, her oirgo, and all on board.' ' The deals were duly delivered at the port cf destination, lees the portions jettisoned. The owners of the Shooting Star refused to con--.tribute to the loss, and the charterer insisted on his right to deduct the sliip's contribution from the freight as for general average. Hence this action, which has terminated in judgment for the defendant, thereby fixing the owners of the Shooting Star with liability to contribute, and pronouncing the jettison of a deck cargo a general, and not a particular, average losi. The Otago Steam Shipping Company's s.s. South Australian, E. Kidney, Commauder, left Port Philip Heads at 8 a.m., on the sth inst.^ and after a pleasant run of fi\e days, two hours, during which she experienced light N.E. winds and fine weather, cast anchor off Hokitika at 10 a.m. on the 10th. The Albion reports that when in latitude 39 deg. 49 mm: S. and longitude 151 cleg. 43 mm. E.'sho spoke the brigantino Mary Stewart, bound to Greymouth, 15 days ant.
