£lOO FINE IMPOSED
Palmerston N., Aug. 15. “I can understand that in this case it is very necessary to impose a fine which will deter others from acting as the defendant has done,” said Mr J. R Herd, S.M., in the Magistrate's Court at Palmerston North, when imposing lines totalling £lOO on James Prudent Willson, a joinery manufacturer.
Willson was charged with breaches of the building regulations in respect of a dwelling-house being erected for him in Weston Avenue, Palmerston North. In the course of evidence it was mentioned that Willson was president of the Manawatu Master Builders Association.
“He seems to think he should act as he likes just because he does not agree with the regulations,” said the Magistrate. "He has taken his own line ol action which, if it is not actually defiance, is little removed from it. These matters are not for individuals to decide.” The first information against Willson was laid by the Palmerston North City Council and charged him with departing without permission from the plans upon which he nad been granted a permit to erect a dwelling by the City Engineer. Be was found guilty on this count and convicted and discharged. The other four informations were laid by the District Building Controller, and alleged (1) that ho had proceeded with work other than in accordance with the permit issued I* him (2)that he had refused to observe or comply with the requirements of tho Building Controller to demolish certain unauthorised work; (3) that without the consent of the Building Controller he had used galvanised iron sheets for purposes other than authorised; and (4> that when notified to stop work, he proceeded in contravention of the terms of the notice.
He was found guiltv on the first and second of these informations and fined £5O and costs on each, the maximum penalty being 12 months’ imprisonment or a fine of £2OO. The second two informations were dismissed.
