WRIT OF PROHIBITION AGAINST MAGISTRATE

RAETIHI 1 ENANCY CASE

A writ ol prohibition against Mr. A. Colenan, S.M., was granted by Mr. Justice Fair in the Supreme Court, Wanganui, vtsterday, on the application of vohn Augustine Drum, baker, of Raetihi. The writ concerned a decision by Mr. Coleman that a shop with dwelling attached was not subject to the Fair Rents Act. Mr. Coleman had ruled that the premises were not let as a separate dwelling, and that the amending Act of 1942 did not apply. Mr. L. N. Ritchie (Raetihi) appeared for plaintiff. The magistrate was not represented, but Mr. L. F. Baird (Raetihi) argued against the issue of the order on behalf of the second defendant, Sydney Herbert Gould, baker, of Kawhai.

Mr. Justice Fair ruled that the premises did come within the protection of the Fair Rents Act, and "issued an crdc-r prohibiting the magistrate from exercising any further jurisdiction in toe matter.
