BREACH OF BY-LAW
STOCK ALLOWED TO GRA/.P ON COUNTY ROAD
“The purpose of this prosecution is to make it clear to defendant that the grazing of stock on county roads is not by the by-laws,” said Mr. W. Thrush, who appeared lor the Waitotara County Council when John Manley was charged in the Magistrate’s Court, Wanganui, yesterday afternoon, that on October 5 he placed, or permitted to remain, eight cows on Virginia Road lor the purpose of pasturing or grazing. Defendant pleaded not guilty. The county ranger, Eric Maxwell Hardy, said that on the morning of October 5 he saw eight cows grazing on Virginia Road, with a man in charge of them. Asked if he was going to persist in grazing them, the man said it was nothing to do with him as it was defendant’s instructions. When interviewed, defendant said he had seen other people grazing their stock on county roads and saw no reason why he should not do so also. Witness added that he had not seen the cows on the road since then.
Defendant said he did not think there were any by-laws to prevent cows from grazing under these circumstances, but the magistrate held that this was no defence.
"In view of the costs I shall impose a fine of £l,” the magistrate said. Costs amounted to witness’ expenses, 13s 4d, solicitor’s fee £1 Is, and Court costs, 10s,
