REGULATIONS TESTED

DELIVERY OF LIQUOR AFTER HOURS. (P.A.) Christchurch, Feb. 12. The judgment of a magistrate in convicting William Ewart Donnithorne, hotel licensee, under the Licensing Act Emergency Regulations, ot supplying two men with liquor after hours was tested before Mr. Justice Northcroft in the Supreme Court this morning. Mr. D. W. Russell, counsel for Donnithorne, said that the liquor had been purchased early in the day and was placed by the licensee in a cupboard. When the man had come back for th» liquor after hours what was being handed to him was simply his own property. Mr. Russell submitted that the sale was completed at the time when the purchaser received the liquor from the barman on his first visit to the hotel. Before the present regulations came into force, if a transaction had been completed in the usual business hours removal could occur later without offence. Mr. A. W. Brown, counsel for the Crown, raised the question of the purpose ot the regulations, which, he Maimed, were to restrict severely the distribution of liquor during times when a hotel was required to be closed. After legal argument had been heard the case was adjourned until Monday.
