The fact that the police did not call as a witness a doctor who had been summoned by them to examine a man charged with intoxication while in charge of a motor-truck was strongly commented upon by counsel in a case heard by Mr E. L. Watson, S.M. Accused was Peter Augustus Gordon, who was arrested in the early hours of the morning following a collision with a cyclist. Three police witnesses gave evidence that accused was intoxicated and unfit to drive, but admitted that Dr. H. Goulding Pace had stated he was sober.

Following protests by counsel at the failure of the police to call Dr. Rice, the doctor was called by the Court, and after hearing his evidence the magistrate said there seemed to be an honest difference of opinion regarding accused’s condition and, giving due weight to the opinion of the medical man, the charge would be I dismissed.
