Expressing the opinion (hat the world “private” used in the Motoi Insurance Company’s policy did not cover the use of an assured person’s car, if that was for the benefit of the business of another person, Mr. Justice Smith, in a reserved judgment delivered to day on a case stated for his ruling, held that Agnes Carroll, a widow and executrix of Frank Mi I ton Carroll, of Taumarunni, builder, was not entitled to recover from the N.LM.U. Insurance Company. The action was a sequal to a fatal collision with a train at Ohakune. The Judge found that at the time of tin accident the car was being driven by the assured, but was being used primarily and substantially for the pur poses of the Hayward Timber Com pany, Ltd., of which he was general manager.
