PRIVY COUNCIL CASE
JUDGMENT RESERVED Received July 17, 5.5 p.m. LONDON, July IG. The Privy Council reserved judgment in Gould and others v. the Commissioner of Stamp Duties, New Zealand. The case. which came before the Full Court at Wellington last year, involves a neat question under the Stamp Duties Act. The appellants are George Gould. Herbert Elworthy, and George Ranald McDonald as trustees of the estate of Ranald Macintosh McDonald, who died at Christchurch on October 21, 1928, leaving an estate, the final balance of which was fixed for death duties at £337,317. Broadly, the question involved is whether a deed of settlement, in the circumstances of the case can be treated as nugatory by the Commissioner of Stamp Duties. The Full Court affirmed the Commissioner’s assessment and the appeal was dismissed. It. was from this decision of the Full Court that the appeal was made to the Privy Counci 1.
