ARCHITECT AND HOTEL BROKER. JORGENSEN v. THOMAS B. DWAN. [Per Press Association.] WELLINGTON, Dec. 10. An action for the recovery of architect L fees totalling £Bl9 ss, and a counter-action involving .i claim for £4OOU for allege!, libel and £5OO for moneys saiu to ue due under mortgages, began in the Supreme Court before Air Justice Ostler. The parties arc Ob‘car Albert Jorgensen, architect, ol Palmerston North, a.d Thomas Beaumont Dwan, hotel broker, of Wellington. Jurgensen is claiming lor the recovery oi £Bl9 ss, the balauce allegedly due by Dwan in respect of professional services. Dwan counter-claims for £5OO tor money allegedly leut to the plaintiff. There are three other cases to follow, namely an action by Jorgensen against Dwan for £4OOO damages for alcged libel, an action by Dwan against Jorgensen for £4OO in respect of an alleged deficiency on a mortgagee ’s saiu and lastly an action by Jurgenson against Dwan to set aside a mortgagee s sale. In the statement for the defence, in the first case, Dwan denied that any money was due to plaintiff for professional services, and further that if any sum, as claimed, was due, then plaintiff had been paid in full and had himself given defendant a full and complete clearance and release. Defendant, in support of his counterclaim, against Jorgensen, declared that in a guarantee given by him he was liable to pay on account of the plaintiff to the National Bank of New Zealand, Ltd., at Palmerston North, £2Ol 17s 7d and interest from July 1930. Dwan also contended that in Alay, June and July, 1929, he had advanced by way of loan to plaintiff for payment to certain contractors, the sum of £450, but that only £l5O of that amount had been paid, leaving £3OO due and owing to defendant by the plaintiff. Dwan claimed for £2Ol 17s 7d and interest, and £3OO as the balance un the loan. The case is proceeding.
