TAKING OF STATEMENTS
THE METHOD CRITICISED (Per Press Association.) AUCKLAND, Oct. 31. The taking of statements from people after arrest was criticised by Judge Smith to-day during the hearing of breaking, entering and theft charges against two men whom a detective stated that according to instructions he had interviewed in gaol. The Judge said: “It is quite in order for statements to be taken before the police have made up their minds to make an arrest, but I do not think men should be interviewed in gaol unless there are exceptional circumstances. While the detective has done nothing wrong in carrying out his instructions, the jury should not pay any attention to these statements, seeing that they were taken after arrest.”
