YIELDED TO TEMPTATION

LORRY DRIVERS LAPSE FINE OF £lO IMPOSED. ‘‘This is the fourth conviction in this district this month,” said Mr .T. S. Barton. S.M., at the Magistrate’s (’ourt yesterday when Arthur Medley was proceeded against by being in charge of a motor lorry in Carlton Avenue on September 14. while in a state of intoxication. ‘‘lt is the second case in which the defendant I has assured me of being unwell and ; cut of sorts, and it is the third, where, in dealing with the license. I have had i tn take into account the living of the i accused. ’’ j It was stated that a man, riding a bicycle along Taupo Quay, had a nar1 row escape from being knocked down Ibv the defendant, who turned from ’ Taupo Quay into Carlton Avenue, and I continued on his way. The lorry ‘swerved from side to side as it went along. When interviewed by the police, the defendant said that he did not remember anything of the incident. Evidence was given by the Mayor of Wanganui (Mr W. ,T. Rogers) that he had never known the defendant to have been drunk before. Mr A. D. Brodie, on behalf of the defendant, said that Medley expressed sincere regret for his lapse. Normally he was a sober man, but he had been out of sorts and had taken liquor. The magistrate said that if the defendant read the newspapers he must see that actions were being brought against drivers in the Dominion every day, and yet he yielded to the temptation to take liquor. A man might drive and he might take liquor, but he could not do both at the same time. His Worship said he took into consideration the fact that defendant was not known to have taken liquor before, and also that he was in poor circumstances, and imposed a line of £lO with. Ifis costs. His license to drive was cancelled for three months. He was allowed a month to pay the fine. If he paid a substantial amount an extension of this time would be considered.
