APPEAL FAILS

THE RAETIHI CASE BINDING OF THE COURT. In dismissing the appeal the Court held that appellant had not proved his case. The fact that tho receipt for monies lent was given in the name of Tustin and Wald egrave was the only evidence that the monies had been received, and appellant had to prove that at that time Waldegrave had accepted liability. The Court accepted Waldegrave’s statement that he did not know of tho loan until three years after it had been made, and upheld the Judge in finding that when the guarantee was given by Waldegrave he had honest doubt as to his liability. The Court did not call upon respondent to argue.
