Winfield) as the result of an alleged collision on the Bulls-Turakina Road, on November 2. Harold Victor Wood, kcrbsidc-pump superviser, Wanganui, was brought forward to give evidence for the plaintiff, and stated that on stopping to pick up some children, he was passed by a Ford car, which he followed for about a quarter of a mile, both being on the right hand side of the road to avoid the loose metal. Several times he alleged he sounded his horn to pass the defendant who did not move over to his correct side. Approaching a cottage on the Wanganui side of the factory, witness noticed a cyclist approaching and slowed up but the Ford kept on until it hit the machine. On pulling up, witness found the front wheel, on the left side of the car, on the cycle with a youth underneath and a man getting up off the road, the man’s hands and one knee being badly lacerated and his trousers torn. Witness told the driver to move back to allow the cyclist to be extricated from under his machine. Witness asked defendant why he had not put his hand out, the defendant replying that he thought the cyclist would see he was pulling up. Wood alleged that even had deefndant put his hand out at the last minute, the cyclist would not have had a chance to pull up. The cyclist had. made an attempt to get clear but had skidded in the loose metal near the crown of the road. Witness and defendant and his passenger were the only ones at the scene of the accident for several minutes, and the whole case seemed to witness carelessness on the part of the defendant.

Mr Winfield cross-examined witness, and the case was adjoined until January 27.
