Moody, builder, of Mangere, failed to appear at the Supreme Court this morning to defend an action by Robert Loth and his wife, Aileen Mary Leth, for £4OO damages, the case arising out of a motor accident on May & Mr Justice Reed told the jury that aa defendant did not chouse to appear, they were entitled to find that damage (injuries to Mrs Leth and damage to plaintiff’s car), was caused by defendant’s negligence in allowing his son, aged 13 years and 11 months, to drive the motor which crashed into the Leth’s car. The jury awarded £154 0s 6d special damages and £246 19s 6d general damages. Costs on tho lowest scale were allowed,
